By accessing or using the James Club Luxembourg platform at global-mtn.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all visitors, members, and others who access or use the Service.

2. Description of Service

James Club Luxembourg is a private travel club that offers members access to curated hotel stays at partner properties through a credit-based membership system. Memberships provide a set number of credits that can be redeemed for hotel nights at participating properties. We act as an intermediary between members and partner hotels; we are not a hotel operator or travel agent.

3. Membership

• Membership is personal and non-transferable unless otherwise agreed in writing.
• Credits granted with a membership have a validity period as stated at the time of purchase (typically 24 months).
• Credits have no cash value and cannot be exchanged for money.
• James Club Luxembourg reserves the right to modify membership tiers, pricing, and benefits with reasonable prior notice.
• Memberships are subject to availability and may be limited at any time.

4. Reservations and Bookings

• All bookings are subject to availability and require confirmation by our team within 3 business days.
• Credits are deducted from your account upon booking confirmation, not upon request.
• We reserve the right to decline or cancel bookings that cannot be honored by the partner hotel.
• In the event of a cancellation initiated by James Club Luxembourg or the hotel, credits will be fully refunded to your account.
• Member-initiated cancellations are subject to our cancellation policy, which varies by property and booking type.

5. Concierge Services

Our concierge team provides assistance with booking and travel-related requests on a best-efforts basis. We do not guarantee outcomes for concierge requests, particularly for hotels outside our partner portfolio. Response times are typically within 3 business days. Concierge services are included with membership and do not carry additional charges unless otherwise stated.

6. Member Conduct

Members agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Share account credentials or allow third parties to use their membership
• Misrepresent their identity or provide false information during registration or booking
• Engage in abusive, threatening, or disrespectful conduct toward our team or hotel partners
• Attempt to circumvent the credit system or exploit pricing errors

Violation of these rules may result in immediate suspension or termination of membership without refund.

7. Payments and Refunds

Membership fees are charged at the time of purchase and are generally non-refundable, except where required by applicable consumer protection laws. If you believe a charge was made in error, please contact us within 14 days. We review all refund requests on a case-by-case basis.

8. Limitation of Liability

To the maximum extent permitted by applicable law, James Club Luxembourg shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the membership in the 12 months preceding the claim.

9. Intellectual Property

All content on the Service, including text, graphics, logos, images, and software, is the property of James Club Luxembourg or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. Any unused credits at the time of termination due to member misconduct will be forfeited.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
